TERMS & CONDITIONS

1. AGREEMENT OVERVIEW

1.1 Entire Agreement. This Agreement contains the complete understanding between I AM ABI FINE ART PHOTOGRAPHY (“Studio”) and the CLIENT. It supersedes all prior negotiations.

1.2 PAMANA Legacy Definition. “PAMANA Packages” (Pamana-Heirloom, Pamana-Prestige, and Royal Dynasty) refer to multi-session, long-term service agreements involving advance payments for future services.

2. PAMANA LEGACY PACKAGES & MEMBERSHIP

2.1 Package Inclusions. The specific assets, sessions, and credits for the PAMANA-Heirloom, PAMANA-Prestige, and Royal Dynasty packages are as defined in the 2026 Branding Guidelines.

2.2 Rate-Lock Guarantee. For PAMANA-Prestige (1 year) and Royal Dynasty (5 years), the price is locked at the time of contract execution. The CLIENT is protected from any studio price increases for the duration of their membership.

2.3 Advance Payment & Membership Fees. * Payment for PAMANA packages is considered a "Legacy Retention" fee.
•    Due to the exclusive nature (e.g., Royal Dynasty limited to 12 families), payments are non-refundable but transferable to immediate family members upon written request from the customer and approval from the Studio.

2.4 Validity Periods.
•    Pamana Heirloom: All sessions must be completed within 6 months.
•    Pamana Prestige: All sessions must be completed within 1 year.
•    Royal Dynasty: All sessions must be completed within 5 years.
•    Failure to book sessions within the period results in the forfeiture of the remaining sessions without refund.

3. STUDIO CREDITS & ASSET STACK

3.1 Studio Credit Usage. Credits (Php 20k, 25k, or 50k) are applicable only for wall art, albums, digital files, gowns, and HMUA services. 

3.2 Non-Convertibility. Studio credits are non-convertible to cash and must be used within the membership validity period.

3.3 Limitations. Studio credits are considered gifts to customers who took the courage to document their legacy for her family. These are limited to 10 customers per Pamana packages that paid full.

3.4 Gown Access. Access to "Timeless" or "Dreamy" Gown Collections is subject to the specific duration of the package (6 months, 1 year, or 5 years).

4. BOOKING, RESCHEDULING, AND CANCELLATION

4.1 Session Coordination. For long-term packages (Royal Dynasty), the CLIENT must provide at least 30-14 days' notice for session bookings to ensure artistic plan is inplaced. Including the mood board generation, online consultation, out sourcing the customer requirements and assigning I am Abi team members.

4.2 I am Abi Talent. As much as the company would like to have a consistent I am Abi personnel for the customer’s photoshoot on her 2nd, 3rd, 4th, etc. I am Abi have the final authority to assign the personnel that will be handling the service for the customer in the future. 

4.3 Rescheduling. * One (1) complimentary reschedule is allowed per session if made at least 14 days in advance.
•    Last-minute rescheduling (less than 3 days) for a PAMANA session will incur a Php 5,000 administrative fee to cover production prep and styling costs.

4.4 Force Majeure. In accordance with Art. 1174 of the Philippine Civil Code, the Studio is not liable for delays caused by fortuitous events (e.g., natural disasters, government lockdowns). Membership durations will be extended by the length of the disruption.

5. INTELLECTUAL PROPERTY & DELIVERABLES

5.1 Painterly Images. "Painterly Images" refer to high-end edited digital files. The Studio retains copyright, while the CLIENT is granted a license for personal, non-commercial use.

5.2 Custom Assets. Custom family emblems and boxes remain the property of the CLIENT once delivered.

6. CONCIERGE & HOME CONSULTATION

6.1 On-Site Installation. For Prestige and Royal Dynasty, the Studio provides on-site installation of fine art frames within Metro Manila or within 50km radius from the studio.

6.2 Liability Waiver. The Studio is not liable for minor structural variations at the CLIENT’s home during installation, provided professional care is exercised.

7. DATA PRIVACY (R.A. 10173)

7.1 Consent. By signing, the CLIENT consents to the Studio storing images for the duration of the 5-year partnership (for Royal Dynasty) to ensure consistency in the family legacy archive.

Legal Effectivity: These terms are binding upon the first payment or signing of the 2026 Package Agreement. All other standard 2025 clauses regarding safety, conduct, and liability remain in full force. https://www.iamabi.com/terms-conditions-2025
